CHARTER CONDITIONS
1. INTRODUCTORY NOTE
Purchasing one of our charter packages results in contractual relationship with the lesser. Only general terms listed in this contract put contractual parties under obligation to each other and are basis for solving any kind of disputes between the lesser and the lessee.
2. DELIVERY
The lesser obliges to deliver only clean and totally equipped vessels, in perfect condition, with full fuel and water reservoirs. It is expected from the lessee to return the vessel in the same condition it was delivered to him. Inventory list will be used to check the vessels equipment and state, after checking the list both parties are obliged to sign the list.
The lessee does not have the right to reduce the rental in case the vessel or the corresponding equipment have some hidden defects that the lesser isn't aware of at the time of delivery, or if such defects occur during the rental period. The base operator should be contacted in case the journey can't be continued for some reason or if exceeding of rental period is unavoidable. The lessee bears all costs in case of exceeding the rental period due to bad weather unless permitted by lesser. Because of this we suggest returning the vessel to base evening before the handout.
3. RENT-ABANDONMENT
If the lessee has to give up his rental he is free to find a replacement lessee who will the over the contract in his name. In case the lessee can't find a substitute the lesser will withhold:
30 % of rental price in case of cancelation 3 months prior to beginning of rental period
50 % of rental price in case of cancelation 3-1 months prior to beginning of rental period
100 % of rental price in case of cancelation 4 weeks prior to beginning of rental period
4. DEPOSIT
The deposit for the vessel will be paid when signing the contract, the amount of the deposit and the manner in which is paid will be listed in the contract. Deposit will be returned if the vessel is in the condition it was delivered and if the vessel is returned within the time listed in the contract.
5. THE LESSOR'S OBLIGATIONS
The lesser commits to deliver the vessel clean and in good condition, with full water and tank reservoirs at the time and place agreed.
If the reserved vessel can't be provided, the lesser commits to providing another vessel of the same or superior quality.
In case the lesser can't provide the vessel reserved or another vessel of the same or superior quality at the agreed time or place, he commits to offer the following options to the lessee:
a) to meet the lessee's expenses for the days spent while waiting to take over the vessel
b) to provide the lessee with the adequate accommodation while waiting for the vessel
c) after 24 hour deadline expires, the lesser has to return sum paid by the lessee.
The lessee has to be informed by the lesser no later than 15 days prior to start of rental in case the rent has to be cancelled for some reason and return him the amount paid.
6. THE LESSEE'S OBLIGATIONS
The lessee commits to pay the rental fee as listed in the Contract.
The lessee commits to deliver the crew list containing the names and addresses of crew members to the lesser either prior to beginning of the rental period or at the delivery of the vessel.
The lessee commits that the number of persons on board will not exceed to number listed on the crew list.
The lessee commits that the skipper of the vessel has all appropriate licenses required by maritime law in Croatia.
The lessee commits to dealing carefully with the vessel.
The lessee commits to respecting the Croatian laws and regulations.
The lessee commits to keeping the log book correctly filled out.
The lessee commits not to lend or sublet the vessel to any third parties.
The lessee commits not to take part in any regatta or competition of other kind, with the vessel without permission or confirmation from the lesser.
The lessee commits that the vessel will not be used in any commercial purposes.
The lessee commits not to steer the vessel in unsafe weather conditions at night.
The lessee commits to checking the oil level of the engine daily
The lessee commits that he won't leave territorial waters of the country in which the vessel was rented without special permission from the lesser or lesser confirmation.
The lessee commits to immediately inform the lesser in case of any damage during the rental period.
If the vessel needs to be repaired in case of any damage, the lessee commits to informing the lesser immediately.
In case of any greater damage with or without other vessel being involved, the lessee commits to reporting the authorized harbor office and the lesser with the purpose of insurance protocol.
The lessee commits not to take any animals on board without the lesser special permission.
In case the vessel or anything from the vessel is stolen, the lessee commits to informing the police and requests the copy of the police report.
The lessee commits to being aware of the weather forecast with the purpose of avoiding danger and delayed delivery.
In the case of delayed delivery the lessee commits to informing the lesser as soon as possible.
The lessee commits to returning the vessel in good condition, with full both fuel and water reservoirs and at the agreed place and time.
The lessee commits to paying one day rental fee in case of delayed deliver for less than 3 hours, in case the delay is greater than three hours; three day rental for every additional day plus all costs arisen for the lesser.
The lessee commits to checking the vessel condition and equipment according to the inventory list when taking over the vessel.
7. RESPONSABILITIES
Relative party can be charged for total compensation of the damage if either side does not fulfill its contracted obligations.
8. INSURANCE
The vessel has obligatory insurance towards third parties and complete insurance for any damages and accident on the vessel, with the franchise up to the amount of the deposit. The insurance excludes damages to things brought on board, compensation for loss of boats equipments, damages caused by users rough negligence or personal accidents on board.
9. CLAIMS
Only the claims that are given in written form when returning the vessel, signed by both lessee and the lesser will be taken into consideration by the lesser.
10. COMPETENCES
For all disputes that can't be solved in the friendly matter, the court of the lesser residence is competent.
11. CURRENCY CONVERSION STATEMENT
All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian kuna according to the current exchange rate of the Croatian National bank.
When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
12. CREDITCARD PURCHASE SECURITY STATEMENTS

Web pages for payments through Internet are secured by using Secure Socket Layer (SSL) protocol with 128/256 bit data encryption. SSL encryption is procedure of data encryption in order to prevent unauthorized access during data transmission. This allows secure information transmission and prevents unauthorized access to data during the communication between Your computer and WebPay service, and other way around.
- WebPay service and financial institutions (credit card houses) exchange data by using virtual private network (VPN), which is protected from unauthorized access. Numbers of credit cards are not stored and not available for unauthorized persons.
